Chapter 13 bankruptcy has been referred to as "the individual's reorganization." It is based on disposable income — your total income minus expenses. It also draws distinctions between debt that is dischargeable and nondischargeable, secured and unsecured.

Chapter 13 protections, unlike Chapter 7, promote the reorganization of debt. Its three- to five-year repayment plan feature allows you to satisfy your obligations while a court protects you from creditors and foreclosure. You can often eliminate more than 90 percent of your unsecured debt and pay the remaining amount over a period of up to 60 months. Your payments go to a bankruptcy trustee, who then distributes funds to your creditors.
