Qualifying for Chapter 13
To qualify for Chapter 13 bankruptcy, you must be within the limitations of maximum secured and unsecured debt set by the federal bankruptcy laws. For a Chapter 13 filing you must have:
- Approximately $1.1 million in secured debt or less
- Approximately $374,000 in unsecured debt or less
If either of your totals of secured or unsecured debt is above these limitations, then you most likely will not qualify for Chapter 13.
