Resulting From a Filing
When your tax debt has resulted from your income tax filing, you are not able to have the debt discharged until three years have passed since the date on which the tax return for that year was due.
Resulting From an Assessment
If the taxes that are to be paid are the result of an assessment rather than an income tax filing, the tax debt only needs to be 240 days old, and conform to the other filing date requirements, in order for you to seek their dismissal under Chapter 7 bankruptcy.
